Texas Hemp Ban Paused Again. Latest Legal Update

Where Things Stand Right Now

Let’s talk about the latest update in Texas because things have been changing fast.

Honestly, it has felt like “put it on, take it off” over and over again these past couple of weeks. Products are legal one day, pulled the next, then back again after another court ruling.

As of May 11, 2026, smokable hemp products are currently still allowed in Texas due to the temporary injunction being reinstated by the appeals court.

That means flower, joints, and certain concentrates are still able to remain on shelves for now while the legal battle continues.

What Happened This Week

Here’s the simplified version.

Earlier this month, the ban on smokable hemp products was briefly allowed to move forward after a state appeal.

Then just days later, on May 7th and 8th, the 15th Court of Appeals reversed that decision and reinstated the temporary injunction again.

So for now, enforcement of those stricter hemp rules is paused once again.

That temporary injunction is expected to stay in place until the full trial takes place on July 27, 2026.

What the Lawsuit Is About

The lawsuit was brought by the Texas Hemp Business Council and other plaintiffs against the Texas Department of State Health Services.

The issue centers around the new rules that took effect March 31, 2026.

Those rules changed how THC is measured by moving toward a total THC standard that includes THCA. If fully enforced, it would effectively eliminate most smokable hemp products in Texas.

The rules also introduced significant increases in licensing fees, which many businesses argued would heavily damage small retailers across the state.

The court is now deciding whether the agency overstepped its authority by making those changes through regulation rather than through lawmakers.

What’s Legal Right Now

As of today, smokable hemp products are still available while the injunction remains active.

That includes products like:
- Flower
- Pre-rolls
- Certain THCA concentrates

At the same time, some regulations still remain in place, including:
- 21 and older age requirements
- Child-resistant packaging
- General compliance standards

So while this is temporary relief, the industry is still operating carefully.

Another Layer of Complexity

At the same time all of this is happening, the Texas Supreme Court also ruled on May 1, 2026, that the Department of State Health Services does have authority to ban Delta-8 THC.

That ruling adds another layer of uncertainty because it shows the state still has significant regulatory power over certain cannabinoids.

So while smokable hemp products are currently protected under the injunction, other parts of the industry are still facing legal pressure.

What Happens Next

Right now, everyone is waiting.

The state is expected to continue appealing the injunction, and many industry leaders believe this fight could eventually make its way to the Texas Supreme Court.

Until then, businesses across the state are trying to adapt in real time.

Products come off shelves. Products come back. Inventory shifts constantly.

For many retailers, it has created a lot of uncertainty and financial strain.
