A Huge Win for All of Us — SB 3 Special Session Update!

Friends and fellow hemp champions, we did it—SB 3 is no longer moving forward, and your voices made all the difference.

What Actually Happened?

  • SB 3 was vetoed in June, protecting small businesses like mine and over 8,000 others across Texas. If it had passed, it would have banned nearly all hemp-derived products and left only a narrow slice of the industry standing.

  • A special session was then called to try and rebuild the bill into something “workable.” Lawmakers debated a new version, SB 5, that would have restricted hemp products down to only CBD and CBG, required costly licenses, and heavily limited what shops like mine could sell.

  • In the end, SB 5 did not pass. That means we remain safe for now, and our shelves will stay full of the hemp-derived products you know and trust.

What’s Allowed vs. What’s Not

Still Allowed:

  • Hemp-derived THC-type products like edibles, snacks, beverages, and flower remain legal in Texas.

  • Possession of these products is not criminalized.

Restricted:

  • As of September 1, 2025, vapes are no longer allowed for sale in Texas. That means no delta-8 or other hemp-based vape cartridges can be legally sold, especially those marketed with youth-appealing packaging.

  • Shops caught selling banned items can face penalties, but possession is not a crime for customers.

Looking Ahead:

  • Broader regulations are still on the horizon. Lawmakers are expected to revisit age limits, potency caps, packaging rules, and licensing systems in the future. For now, we’ve bought two years of breathing room.
